Please read these Terms and Conditions (“Terms”) carefully. They apply to your use of our website and to any Nutryvyt products or services you order online. By using our website or placing an order, you agree to these Terms.

1) General

Website details

This website is owned and operated by Nutryvyt Supplements & Nutrition (“Nutryvyt”, “we”, “us”, “our”). Registered in Zambia. Principal place of business: Plot 1638/2716 Malambo Road, Lusaka, Zambia.

Application of Terms

These Terms govern your use of our website and any online orders. They replace any prior terms to the extent allowed by law. Do not use the website if you do not agree.

Changes to Terms

We may update these Terms at any time. We will post changes here. Continued use of the website means you accept the updated Terms.

Applicable law

These Terms are governed by the laws of the Republic of Zambia.

2) Using our website

  • You may browse and use the website for personal, non-commercial purposes only.
  • Do not copy, modify, distribute, deep link, scrape, upload malware or unlawful content, or interfere with the website.
  • We may restrict access, suspend the website, or terminate accounts if we believe there is misuse or inaccurate information.
  • You agree to indemnify Nutryvyt against loss, damage, claims, or costs arising from your misuse of the website.

Privacy and information security

Your privacy matters to us. Personal information is handled under our Privacy Policy and the Zambian Data Protection Act, 2021. We use secure payment gateways. No method is perfectly secure, so use the Site at your own risk.

3) Accuracy of content, pricing, and availability

  • We take reasonable steps to ensure information on the website, social channels, and emails is accurate and current. Errors and omissions are excepted.
  • Prices are shown in Zambian Kwacha (ZMW) and are valid for online purchases in Zambia only.
  • Products, specifications, and prices may change without notice.
  • Product photos are for illustration. Actual packaging may vary.
  • We reserve the right to limit quantities. Promotional availability may vary.

4) Your comments and content

We value your suggestions, reviews, and comments (“Comments”), but we do not provide compensation. By submitting Comments, you grant Nutryvyt a non-exclusive, royalty-free right to use them for any purpose. You confirm you own or control the rights to your Comments and that they do not infringe any third-party rights or contain unlawful, defamatory, or obscene material. You remain responsible for your Comments.

5) Intellectual property

All content on the website, including logos, trademarks, text, graphics, images, audio, video, design, software, and data compilations, is owned by or licensed to Nutryvyt. You may view, print, or store one copy for personal, lawful, non-commercial use. Any other use is prohibited without prior written consent.

6) Online shopping

Registration

You may check out as a guest or create an account. If you register, keep your password confidential. You are responsible for activity under your account. Update your details in My Account if anything changes.

Product sales and availability

All products are subject to availability. Online sales are available within Zambia only.

Pricing policy

Prices include applicable taxes and may differ from prices at other sales channels. Promotions may have conditions such as limited stock or time windows. A delivery fee may apply and will be shown at checkout.

Payment methods

We accept common payment options in Zambia such as major cards, MTN MoMo, Airtel Money, Zamtel Kwacha, and bank transfer, subject to availability. By submitting an order, you confirm you are over 18, authorized to use the payment method, and have sufficient funds. We will debit on acceptance of your order and prior to delivery.

Stock availability

We cannot always guarantee stock. If an item is unavailable, we will notify you and offer an alternative, a back-order, or a refund for that item.

Order acceptance and confirmation

Your order is an offer to buy. We accept when we send an order confirmation. If there is a material error in price or description, we may decline or cancel and refund any payment taken.

Delivery

  • Delivery is Monday to Friday during business hours. No deliveries on weekends and public holidays.
  • Standard delivery timeframe is 2 to 7 working days after payment, depending on location and courier service levels.
  • At delivery, the recipient may be asked for ID. Anyone present at the address is presumed authorized to accept delivery.
  • If no one is available, the courier will retain the parcel and attempt to arrange another delivery. Additional delivery fees may apply if re-delivery is required.
  • Inspect your order on receipt and report visible damage to the courier and to Nutryvyt within 24 hours.

Risk and title

Risk passes to you on delivery. Ownership passes when we receive full payment.

Returns and refunds

Our Returns and Refunds Policy applies. In short

  • Returns accepted within 7 days only for defective or unsuitable products, subject to inspection.
  • Items must be sealed and untampered.
  • For health and safety reasons, opened, unsealed, or partially used supplements cannot be returned or exchanged unless required by law for a proven defect.
  • Approved refunds are processed by the original method where possible, or by mobile money, bank transfer, or store credit within 7 to 14 business days after approval.

Order cancellation

If you wish to cancel, contact us before dispatch. Acceptance of cancellation is at our discretion. We may charge delivery and admin fees where costs have been incurred. If you reverse or cancel payment without a valid basis, you remain liable for the full purchase price and any recovery costs.

Delivery providers

We use third-party couriers. To the extent allowed by law, we are not liable for their acts or omissions. We will support you to resolve courier issues.

7) Promotions and discount codes

  • All offers are while stocks last and may have specific terms such as end dates, product exclusions, or minimum spend.
  • Discount codes cannot be used on already discounted products unless stated.
  • One code per order unless stated.

8) Competitions and giveaways

By entering, you agree to these rules

  • Open to residents of Zambia who are 18 or older, except Nutryvyt employees, agents, and immediate family.
  • Winners will be contacted by phone, SMS, WhatsApp, or email. If a winner does not respond within 2 working days, we may select another winner.
  • Prizes are not transferable or exchangeable for cash unless stated.
  • We are not responsible for lost, late, corrupted, or misdirected entries.
  • We may disqualify entries if fraud or cheating is suspected.
  • Our decision is final and no correspondence will be entered into.
  • We may amend competition terms without prior notice where required by law or for reasonable operational reasons.

9) Loyalty or rewards (if applicable)

If Nutryvyt introduces a rewards program, separate terms will apply and will be posted on the website. Rewards may expire after a set period and may not be combined with other promotions.

10) Advertising and third-party links

Third-party adverts or links may appear on our website. We do not endorse third-party products or services. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

11) Disclaimers and limitation of liability

  • Use of the website is at your own risk. We do not warrant that the website will be uninterrupted, secure, error free, or free of viruses.
  • To the fullest extent permitted by Zambian law, Nutryvyt is not liable for direct, indirect, incidental, special, or consequential loss or damage arising from use of the website or purchase of products, except where caused by our gross negligence or willful misconduct.
  • Nothing in these Terms limits rights you have under the Competition and Consumer Protection Act, 2010, or other non-excludable rights under Zambian law.

12) Indemnity

You agree to indemnify Nutryvyt from claims, losses, damages, costs, and expenses arising from your breach of these Terms or misuse of the website.

13) Suspension and termination

We may suspend the website or terminate accounts if we believe there is misuse, fraud, a breach of these Terms, or if required by law.

14) Severability and no waiver

If any clause is invalid or unenforceable, the remaining clauses remain in effect. Any delay or indulgence is not a waiver of rights.
